- AI-assisted recommendation systems; and

BY ACCESSING OR USING THE SERVICES, YOU:

- AGREE TO BE LEGALLY BOUND BY THEM;

- AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

- Destination Match Pro;
- the Free Destination Match;
- downloadable materials;
- travel-related informational content;
- family travel educational content; and
- related informational and educational services.
The Company reserves the right to modify, update, suspend, discontinue, or remove any portion of the Services at any time without notice.
3. INFORMATIONAL & EDUCATIONAL PURPOSES ONLY
All Services are provided for informational and educational purposes only.
Nothing contained within the Services constitutes:
- legal advice;
- immigration advice;
- visa advice;
- medical advice;
- financial advice;
- tax advice;
- educational advice;

- family friendliness;
- safety considerations;
- visas;
- worldschooling;
- cost of living; or
- lifestyle considerations
are informational opinions only and should not be relied upon as professional advice.
You are solely responsible for independently verifying all information before making decisions related to:

- immigration;
- healthcare;
- safety;
- finances;

- transportation;
- housing; or
- lifestyle changes.
4. TRAVEL RISK DISCLOSURE
Travel inherently involves risks that may include:
- illness;
- injury;
- political instability;
- transportation disruptions;
- crime;
- natural disasters;
- financial loss;
- changing regulations;
- immigration issues;
- housing issues;
- family safety concerns; and
- changing geopolitical conditions.
Conditions may change rapidly and without notice.
The Company does not guarantee:
- safety;
- suitability;
- legality;
- affordability;
- accessibility;
- availability; or
- appropriateness
of any destination, recommendation, or travel-related information.
You acknowledge and voluntarily assume all risks associated with travel and decisions made using the Services.
5. ARTIFICIAL INTELLIGENCE DISCLOSURE
Certain Services, including Destination Match Pro and related recommendation systems, use artificial intelligence (“AI”), automated systems, algorithmic workflows, and proprietary prompting structures.
Outputs may be:
- AI-generated;
- AI-assisted;
- incomplete;
- inaccurate;
- outdated;
- subjective; or
- based on changing information.
AI-generated outputs are not manually reviewed before delivery.
The Company makes no warranties regarding:
- accuracy;
- completeness;
- reliability;
- real-time validity;
- suitability; or
- fitness for a particular purpose.
You acknowledge and agree that:
- AI systems may produce inaccurate information;
- independent verification is required; and
- the Services should not be relied upon as the sole basis for major life or travel decisions.
6. USER RESPONSIBILITY
You are solely responsible for:
- independently researching and verifying information;
- evaluating destination suitability;
- complying with immigration laws and regulations;
- obtaining visas and travel documentation;
- making healthcare and safety decisions;
- making financial decisions;
- selecting housing and transportation;
- complying with local laws; and
- determining whether destinations or recommendations are appropriate for your circumstances.
You agree not to rely exclusively on the Services when making significant decisions.
7. ELIGIBILITY
You must be at least 18 years old to use paid Services or submit purchases through the website.
By using the Services, you represent and warrant that:
- you are at least 18 years old;
- you have legal capacity to enter into these Terms; and
- all information submitted by you is truthful and accurate.
8. PAYMENTS & DIGITAL PRODUCTS
Payments for Services may be processed through third-party payment processors, including Stripe.
By submitting payment, you:
- authorize the transaction;
- agree to pay all applicable charges; and
- acknowledge that digital processing and fulfillment may begin immediately after purchase.
The Company reserves the right to refuse, limit, revoke, or cancel Services at its sole discretion.
9. REFUND POLICY
Due to the digital, personalized, informational, AI-assisted, and immediately consumable nature of certain Services, all sales are final once processing or fulfillment begins.
NO REFUNDS WILL BE PROVIDED FOR:
- subjective dissatisfaction;
- disagreement with recommendations;
- expectations mismatch;
- failure to independently verify information;
- failure to use purchased materials;
- perceived lack of personalization;
- claims that outputs “felt AI-generated”;
- changes in personal circumstances;
- spam or promotions-folder delivery;
- inaccurate user-submitted information; or
- dissatisfaction with travel-related outcomes.
Subjective dissatisfaction does not constitute grounds for refund.
The Company may, at its sole discretion, issue goodwill refunds in limited circumstances but is under no obligation to do so.
10. DELIVERY & FULFILLMENT
Digital products and Services are considered fulfilled once:
- delivered electronically;
- transmitted to the email address provided by the user; or
- made available through the applicable platform or system.
Users are responsible for:
- submitting accurate contact information;
- monitoring spam/promotions folders; and
- ensuring delivery capability.
Delivery timelines are estimates only and are not guaranteed.
11. BLOG CONTENT & USER COMMENTS
Blog posts, articles, newsletters, and educational content reflect informational opinions, personal experiences, and educational commentary only.
Comments submitted by users may be monitored, moderated, removed, or deleted at the Company’s discretion.
Users agree not to post:
- unlawful content;
- defamatory material;
- spam;
- abusive language;
- harassment;
- malware; or
- infringing content.
The Company is not responsible for user-generated comments or third-party content.
12. INTELLECTUAL PROPERTY RIGHTS
All content, branding, systems, methodologies, workflows, recommendation structures, blog content, prompts, graphics, text, educational materials, frameworks, designs, digital products, and proprietary logic are the exclusive property of Zavenly, LLC DBA Wanderlust Haaks.
This includes but is not limited to:
- blog content;
- travel frameworks;
- AI prompting systems;
- workflows;
- recommendation methodologies;
- automation systems;
- scoring systems;
- written materials;
- graphics;
- branding; and
- generated outputs.
The Services are licensed for personal, non-commercial use only.
You may not:
- copy;
- reproduce;
- republish;
- redistribute;
- scrape;
- reverse engineer;
- commercially exploit;
- resell;
- train AI systems using our materials;
- create derivative works; or
- use the Services to create competing products.
No ownership rights are transferred to users.
13. PROHIBITED CONDUCT
You agree not to:
- abuse or harass Company personnel;
- engage in fraudulent chargebacks;
- interfere with platform operations;
- scrape or harvest data;
- misuse the Services;
- impersonate others;
- violate applicable laws;
- bypass security measures; or
- commercially exploit Company materials.
The Company reserves the right to terminate or restrict access at any time for any reason.
14. THIRD-PARTY SERVICES
The Services may integrate with or rely upon third-party providers, including but not limited to:
- Stripe;
- Airtable;
- n8n;
- Tally;
- Fillout;
- email service providers;
- analytics providers; and
- AI infrastructure providers.
The Company is not responsible for:
- third-party outages;
- service interruptions;
- platform failures;
- data breaches;
- third-party conduct; or
- technical interruptions beyond our control.
Use of third-party services may also be governed by their own terms and privacy policies.
15. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAVENLY, LLC DBA WANDERLUST HAAKS SHALL NOT BE LIABLE FOR ANY:
- direct damages;
- indirect damages;
- incidental damages;
- consequential damages;
- special damages;
- punitive damages;
- emotional distress;
- lost profits;
- travel disruptions;
- injuries;
- illnesses;
- immigration issues;
- financial losses;
- transportation issues;
- housing issues;
- safety incidents;
- family outcomes; or
- decisions made based on the Services.
YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.
THE COMPANY’S MAXIMUM TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE APPLICABLE SERVICE.
16. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Zavenly, LLC DBA Wanderlust Haaks and its owners, officers, employees, affiliates, contractors, successors, and partners from and against any claims, liabilities, damages, losses, expenses, or legal fees arising from:
- your use of the Services;
- your travel decisions;
- your violation of these Terms; or
- disputes involving third parties.
17. PRIVACY
Your use of the Services is also governed by our Privacy Policy.
By using the Services, you acknowledge that information may be collected, processed, and stored in accordance with the Privacy Policy.
18. INTERNATIONAL USERS
The Services may be accessed internationally.
Users are responsible for compliance with local laws and regulations applicable in their jurisdiction.
Certain limitations or disclaimers contained in these Terms may not apply in jurisdictions where prohibited by law.
19. INFORMAL DISPUTE RESOLUTION
Before initiating legal proceedings, you agree to first contact the Company at anna@wanderlusthaaks.com and attempt to resolve disputes informally.
Both parties agree to make good-faith efforts to resolve disputes prior to litigation.
20. GOVERNING LAW & VENUE
These Terms shall be governed by and interpreted in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any legal action arising out of or relating to these Terms or the Services shall be brought exclusively in the appropriate state or federal courts located in North Carolina.
You consent to the jurisdiction and venue of such courts.
21. FORCE MAJEURE
The Company shall not be liable for delays or failures resulting from causes beyond its reasonable control, including but not limited to:
- natural disasters;
- internet outages;
- cyberattacks;
- labor disputes;
- governmental actions;
- war;
- terrorism;
- civil unrest;
- pandemics;
- epidemics; or
- third-party platform failures.
22. MODIFICATIONS TO TERMS
The Company reserves the right to update or modify these Terms at any time.
Updated Terms become effective immediately upon posting.
Continued use of the Services after changes constitutes acceptance of the revised Terms.
23. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain fully enforceable.
24. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements, communications, representations, or understandings.
